Terms of Use for Alia
Welcome to the platform of Alia, owned by Cosmic Flowing LDA, Rua Dom Afonso Henriques 132
4950-854, Moncao – Portugal (hereinafter referred to as"Alia").
The Alia Platform is available at alia.cx or at any other address that may replace it (hereinafter the "Platform"). These Terms of Use(hereinafter the "Terms of Use") govern the contractual relationship between Alia and the user or member and determine the conditions under which users or members may access and use Alia’s platform and services.
1. Definitions
Unless otherwise specified in these Terms of Use, the following capitalized terms shall have the respective meanings given below:
● Content: Refers to all content posted on the Platform, including but not limited to user audio recordings, transcripts,data, information, text, descriptions, photos, videos, and other elements provided by the User, Member, or any third party to Alia or on the Platform.
● Member: Refers to any User who has registered on the Platform and whose registration has been approved by Alia.
● Party: Means, individually or jointly, Alia and/or the User.
● Services: Refers to all online services provided by Alia, including but not limited to voice analysis, AI-driven conversation, transcript generation, and related features as described in more detail in Article 3 of these Terms of Use.
● User: Refers to any person who accesses the Platform, whether they are a Member or not.
2. Applicability of the Terms of Use
2.1. Precedence
These Terms of Use, which take precedence over any other document, govern the relationship between Alia and each User or Member.
2.2. Acceptance
By accessing the Platform and using the Services, the User or Member expressly agrees, without limitation, to be bound by all the provisions of the Terms of Use. If the User or Member does not accept these Terms of Use, they must immediately stop using the Platform and,if applicable, terminate their registration.
2.3. Modifications
Alia reserves the right to modify these Terms of Use at any time and will notify Members by email. Changes will be effective 30 calendar days after they are posted online. Members may notify Alia of any objections to the changes within this period; otherwise, the changes will be deemed accepted.
3. Description of Services
3.1. Overview
The primary goal of the Alia Platform is to provide a cutting-edge Voice AI solution that enables businesses to:
● Conduct automated voice interactions.
● Analyze user responses using advanced AI-driven metrics.
● Generate transcripts and insights to enhance decision-making processes.
3.2. Scope
Alia acts as a facilitator between businesses and clients and users of the voice AI system. Alia does not participate in decisions or transactions between parties using the platform.Users are solely responsible for decisions made based on the data provided by Alia’s Services.
3.3. Access
Currently, the Platform and Services are provided as freemium to enhance adoption and accessibility. Alia reserves the right to introduce fully paid services in the future with prior notification to Users.
4. Access to the Services and Right of Use
4.1. Ownership
Alia retains full ownership of the Platform and its intellectual property.
4.2. User Access
Access to the Platform is available to all Users. However, certain advanced features require registration as a Member.Members are responsible for providing accurate and up-to-date information during registration.
4.3. Registration Approval
Alia reserves the right to accept or deny registration requests at its discretion.
4.4. Modifications and Interruptions
Alia may update, suspend, or modify the Platform or its Services for maintenance, operational requirements, or other reasons without liability or compensation.
4.5. Account Deletion
Members may delete their accounts by contacting support@alia.cx. Account deletion will terminate access to the Platform and all associated Services.
4.6. No Guarantee
Alia does not guarantee uninterrupted or error-free access to the Platform and Services.
5. Term and Termination of the Contract
5.1. Effective Period
These Terms of Use are effective from the User’s first access to the Platform and remain in force until terminated by either Party.
5.2. Termination by User or Alia
Access to the Platform may be terminated at any time by either Party through email notification or via the Platform.
5.3. Serious Violations
Alia reserves the right to suspend access immediately in cases of serious violations, including breaches of Articles 4.2,6, 7, and 9.
6. Registration
6.1. Member Obligations
Members must provide accurate, up-to-date information during registration and correct any inaccuracies promptly.
6.2. Account Use
Each Member may maintain only one account, except with prior approval from Alia. Login credentials must be kept confidential.
6.3. Breach of Obligations
Failure to comply with registration obligations may result in account suspension or termination.
7. User Rights and Obligations
7.1. Prohibited Activities
Users must not:
● Post offensive, illegal, or misleading content.
● Violate intellectual property rights.
● Engage in activities harmful to Alia’s reputation.
● Use automated tools to extract Platform data.
7.2. Consequences of Violations
Violations may result in account suspension, removal of offending content, and potential legal action.
8. Personal Data
Alia collects and processes personal data in accordance with its Privacy Policy,available on the Platform.
9. Intellectual Property& Licensing
9.1. Ownership
All intellectual property rights to the Platform and Services are owned by Alia ( Cosmic Flowing LDA) or its licensors.
9.2. Limited License
Users are granted a non-exclusive,non-transferable license to access and use the Platform for personal or business purposes.
10. Liability
10.1. Disclaimer
The Platform and Services are provided"as is" without warranty of any kind. Alia disclaims liability for interruptions, inaccuracies, or other issues arising from the use of the Platform.
10.2. Limitation of Liability
In no event shall Alia be liable for indirect, incidental, or consequential damages arising from the use of the Platform.
11. Force Majeure
Neither Party is liable for delays or failures resulting from circumstances beyond their control, such as natural disasters or government actions.
12. Completeness -Severability
If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain valid and enforceable.
13. General Provisions
13.1. Continuity
Changes to Alia’s legal status do not affect the validity of these Terms.
13.2. Notifications
All notices must be sent in writing,preferably by email.
14. Governing Law -Jurisdiction
14.1. Applicable Law
These Terms are governed by the laws of[Your Country].
14.2. Dispute Resolution
Disputes will be resolved amicably through mediation before escalating to court proceedings.
15. Changes to the Service
Alia reserves the right to modify or discontinue any aspect of the Platform or Services, with prior notice where possible.
16. Complaints Procedure
Complaints may be submitted via email to support@alia.cx. Alia will aim to resolve complaints within 30 calendar days.

The Platform may contain links to third-party websites. Alia is not responsible for the content or privacy practices of these external sites.
